EDGEWOOD – An Edgewood man accused of giving meth to a teen in December had been indicted on federal gun charges.
A grand jury handed up an indictment charging Brett John Schmerbach, 44, on one count of felon in possession of a firearm on Aug. 22. He pleaded not guilty during an appearance in U.S. District Court in Cedar Rapids on Aug. 25.
He has been released from custody pending trial, which has been tentatively set for Oct. 16.
The indictment alleges Schmerbach was in possession of a 20-gauge Browning shotgun, a 12-gauge Remington shotgun, and a Henry .22-caliber rifle on Dec. 30. He is barred from possessing firearms because of prior operating while intoxicated convictions.
In December, Schmerbach was arrested for distribution of drugs to a person under age 18 and administering harmful substances after he allegedly gave meth to a 14-year-old girl at his home on Morrison Street. The girl was taken to a hospital and tested positive for meth, court records state.
