Waterloo, Iowa April 2, 2019 The Board of Supervisors of the County of Black Hawk, in the State of Iowa, met in regular adjourned meeting at the Courthouse in Waterloo, County Seat of said County, at nine o’clock (9:00) a.m., pursuant to law, to the rules of said Board, and to adjournment. The meeting was called to order and on roll call there were present: Linda Laylin, Chris Schwartz, Dan Trelka, Craig White and Tom Little, Chair. Absent: None. Unless otherwise noted, all actions were approved unanimously. Moved by White, seconded by Schwartz that the AGENDA be received and place on file with the County Auditor as approved. Motion carried. The Board of Supervisors acknowledged the following employees for years of service: Angela M. Graham of the Health Department for 20 years of service. NAYS: None. Resolution adopted. RECEIVE PROJECT UPDATES FROM DEPARTMENT HEADS/ELECTED OFFICIALS. County Engineer Cathy Nicholas said gravel roads are firming up but are still presenting frost boils in some places. She said that the new bolts have been installed for the abutment for the Finchford Road bridge project. The Board asked her about embargoing degraded roads. She said she seldom does so because of their importance for traffic, and that there is an option in the law of embargoing a road but allowing vehicles to use it with a permit for a fee, and the Board may wish to consider it for next year. Veterans Affairs Director Yolando Loveless gave an update after his first month or so in his position. He said that he will receive his certification soon, that his department is visiting veterans in nursing homes to see what their needs are, that they are installing a ramp at a veteran’s home using donated funds, that he has ordered service flags for his office, that he is attending a PTSD conference at the University of Northern Iowa, and he has talked to Maintenance Superintendent Rory Geving about the planned renovation in his department. BE IT HEREBY RESOLVED that the 28E CONTRACTUAL AGREEMENT between BHC and the city of Raymond for providing law enforcement services effective July 1, 2019 through June 30, 2020 in the amount of $24,069.83 be approved. Little asked if the amount was different from last year. Finance Director Susan Deaton said she wasn’t sure but didn’t think so. Little said that it should increase 3% a year because the county’s costs continually increase. Trelka and White agreed. AYES: Laylin, Schwartz, Trelka, White. NAYS: Little. Resolution adopted. Moved by Laylin, seconded by White to direct the County Auditor to advertise for a public hearing to be held at 9:05 a.m. on Tuesday, April 16, 2019 in Board Room 201 of the Black Hawk County Courthouse, 316 E. 5th Street, Waterloo, Iowa on the proposed Ordinance No. 77225 from a request submitted by James Bosier at 6410 N Butler Road to rezone 4.5 acres from “A” Agriculture District to “A-R” Agricultural-Residential District to allow for the construction of three new single family homes. Motion carried. Moved by Laylin, seconded by Schwartz to direct the County Auditor to advertise for a public hearing to be held at 9:07 a.m. on Tuesday, April 16, 2019 in Board Room 201 of the Black Hawk County Courthouse, 316 E. 5th Street, Waterloo, Iowa on the proposed Ordinance No. 77226 from a request submitted by Shawn and Melissa Koenen at 6114 Ford Road to rezone 4.95 acres from “A” Agriculture District to “A-R” Agricultural-Residential District to allow for the construction of three new single family homes. Motion carried. Laylin moved the following resolution seconded by Schwartz. BE IT HEREBY RESOLVED that the TAXES DUE AND PAYABLE of the submitted persons, as indicated, including special assessments, and rates or charges, including interest, fees and cost, in accordance with the provision of §427.9 of the Code of Iowa, be suspended and that future property taxes on property owned by the persons will be suspended for such time as the persons remains the owner of the parcels, and during the period the persons receives assistance as described in §427.9 of the Code of Iowa. AYES: Laylin, Schwartz, Trelka, White, Little. NAYS: None. The Board of Supervisors discussed the settlement offer of $394,559 from United Health Care with respect to PMI claims from April 1st, 2016 to July 23, 2017. Assistant County Attorney Mike Treinen said he had thought the settlement agreement would be ready for approval today, but he listed a number of changes that he has requested, and said while agreement has been reached on most of them, United Health Care still hasn’t agreed to remove a confidentiality clause that must be removed per Iowa law. He hoped he would have a final agreement ready for the April 9 meeting. ANY REPORTS OR INFORMATION FROM THE BOARD. Schwartz said that he attended Urban County Coalition Day at the Iowa Capitol, where members of the coalition met with legislative leadership primarily on the pending property tax bill and the children’s mental health bill. He said the 2% annual growth allowed in the property bill could all be taken up by the needs of children’s mental health. White said that the County Social Services Consortium is prepared to go forward with child mental health care regardless. On motion and vote the meeting adjourned.
